Overview: During COVID-19, the 26-week period of protection against dismissal in the event of incapacity for work is extended. Salaried workers who have fulfilled their information obligations (notification on the first day of absence and presentation of the medical certificate at the latest on the third day or within 8 days in case of urgent hospitalisation), are protected against dismissal for the duration of their incapacity for work, within a limit of 26 weeks from the day the incapacity for work occurred.

Consequently, from the first day of the 27th week of protection against dismissal, the employer who has been notified or is in possession of the worker’s medical certificate is only allowed to dismiss or summon the worker to the pre-dismissal interview for serious reasons.
