Overview: Movements can only take place if motivated by work needs or situations of necessity or for health reasons to be certified by self-declaration, which can also be made sitting immediately by filling in forms provided by the police force. This is the provision of the prefect directive of 8 March 2020 adopted by the Ministry of the Interior with specific indications for controls in territories “with enhanced containment”. An absolute ban on leaving home, however, is provided for people who have undergone quarantine or who have tested positive for the virus.The veracity of the self-declaration can also be verified with subsequent checks. The sanction for those who violate the limitations on travel is the one provided generally by article 650 of the penal code (non-compliance with an order of an authority: penalty provided for arrest of up to three months or a fine of up to 206 euros) unless a more serious hypothesis can be configured such as that provided for by article 452 of the Criminal Code (culpable crimes against public health which pursues all conducts capable of producing a danger to public health). Check are in place to ensure movement restrictions are adhered to.
